Daarnaast moet rekening worden gehouden met het feit dat hierdoor wellicht een (brand)gevaarlijke situatie kan ontstaan. De VvE is er dan ook bij gebaat dat aan deze situatie een einde wordt gemaakt. Voor wat betreft zowel de bouwmaterialen als de beschadiging van het tapijt geldt dat de betreffende eigenaar ingevolge het modelreglement aansprakelijk is voor de toegebrachte schade danwel de onredelijke hinder aan de gemeenschappelijke gedeelten en zaken (zie artikel 16 Modelreglement 1992 en artikel 20 Modelreglement 2006).
